Terms of Service

These terms are a contract between you and Basix Brands LLC ("Basix for Men," "we," "us"). By using https://basixformen.com, creating an account, or placing an order, you agree to them. If you do not agree, do not use the site.

Section 13 contains a binding arbitration clause and a class action waiver that affect how disputes are resolved. Please read it.

1. Who can use this service

You must be at least 18 years old and located in the United States in a state where our providers are licensed. You must provide accurate information about yourself and keep it current. You may not create an account for anyone else or request treatment on someone else's behalf.

2. We are not your healthcare provider

Basix for Men is a technology platform. We operate a store and a patient portal. We do not practice medicine, we do not provide medical advice, and we do not review your intake.

Licensed healthcare providers who use the platform are independent professionals. They are solely responsible for the medical care they provide and for the decision to prescribe or decline to prescribe. Pharmacies that dispense medication are independently licensed and solely responsible for dispensing.

Nothing on this site creates a provider-patient relationship between you and Basix for Men. Content on the site is general information, not medical advice, and is not a substitute for care from a qualified professional.

3. Treatment is not guaranteed

Submitting an intake and paying for a plan is a request for evaluation, not a purchase of a specific medication. A provider may decline to prescribe, may prescribe something different from what you expected, or may require more information before deciding. If treatment is not authorized, you receive a full refund under our Refund Policy.

4. Medical emergencies

This service is not for emergencies. If you think you may be having a medical emergency, call 911 or go to the nearest emergency room. Do not use the patient portal to report an emergency.

5. Your account

You are responsible for keeping your credentials confidential and for everything that happens under your account. Tell us promptly at support@basixformen.com if you believe your account has been accessed without your permission.

6. Orders, pricing, and payment

Prices are shown in US dollars and may change. We may correct pricing errors and cancel affected orders, refunding you in full. You authorize us and our payment processor to charge your payment method for the amounts you agree to at checkout, including recurring charges described in our Subscription Policy.

7. Subscriptions

Plans on this site renew automatically until you cancel. The billing interval, renewal amount, and cancellation method are described at checkout and in our Subscription Policy, which is part of these terms.

8. Refunds, shipping, and returns

Our Refund Policy and Shipping Policy are part of these terms. Prescription medication cannot be returned or resold once it has shipped.

9. Acceptable use

You agree not to:

• Give false information in your intake or misrepresent your identity, age, or medical history
• Resell, share, or divert any medication prescribed to you
• Use the site to obtain medication for anyone other than yourself
• Scrape, reverse engineer, overload, or interfere with the site or the portal
• Upload anything unlawful, infringing, or malicious

We may suspend or terminate your account for any of the above.

10. Our content

The site, its text, images, and design are owned by us or our licensors and protected by intellectual property law. You may use the site for your own personal, non-commercial purposes. Everything else requires our written permission.

11. Disclaimer of warranties

The site and the platform are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error free.

This section does not limit the professional obligations of the licensed providers or pharmacies who serve you, and it does not disclaim liability that cannot be disclaimed under law.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to these terms or the site will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred dollars.

Some states do not allow these limits, so parts of this section may not apply to you.

13. Dispute resolution, arbitration, and class action waiver

Please read this section carefully. It affects your legal rights.

Except for claims that qualify for small claims court and claims seeking injunctive relief for intellectual property misuse, you and we agree that any dispute arising out of or relating to these terms or the site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in the county where you live or by remote hearing, at your election.

Class action waiver. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Your right to opt out. You may reject this arbitration agreement by emailing support@basixformen.com with your name and the subject line "Arbitration Opt-Out" within 30 days of first accepting these terms. Opting out will not affect any other part of these terms, and it will not affect your account or your treatment.

If the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section will still apply.

This section does not prevent you from filing a complaint with a government agency, and nothing in these terms waives any right that cannot be waived under law.

14. Governing law

These terms are governed by the laws of the State of California, without regard to conflict of laws rules. Where arbitration does not apply, the state and federal courts located in Los Angeles County, California have exclusive jurisdiction.

15. Changes

We may update these terms. If a change is material, we will update the date above and notify you. Continuing to use the site after a change means you accept the updated terms.
